Provisions made to the Uniform Act in the State of Illinois

The state of Illinois has adopted the federal Uniform Relocation Assistance and Real Property Acquisition Policies Act (URA) into its legal framework, ensuring that individuals and entities displaced by public projects receive appropriate assistance. Key provisions are outlined in the Illinois Compiled Statutes (ILCS) and the Illinois Administrative Code.​

  • 310 ILCS 40/1a: Defines “displaced person” in alignment with Section 101 of the federal URA.​
  • 310 ILCS 40/2: Allows state agencies to match federal funds for direct financial assistance to displaced persons, under conditions set by federal law.​
  • 735 ILCS 30/10-5-62: Mandates that condemning authorities reimburse displaced persons for reasonable relocation costs, determined in the same manner as under the federal URA.​
  • 20 ILCS 5/5-675: Authorizes the Department of Transportation and the Department of Natural Resources to operate relocation programs and pay relocation costs, exceeding federal maximum payment limits when necessary to ensure decent, safe, or sanitary housing or to secure a suitable relocation site.​
  • 605 ILCS 10/9.5: Empowers the Illinois State Toll Highway Authority to acquire property and operate relocation programs in compliance with the federal URA, with the authority to exceed federal payment limits when necessary.​
  • 92 Ill. Adm. Code 518.10: Establishes policies and procedures for the Illinois Department of Transportation’s Division of Highways when applying the URA to highway projects involving displacement, ensuring compliance with federal requirements.​
